Desc, قرار لجنة إعادة التنظيم المالي رقم (2/5) صادر بتاريخ 4/5/2020م. الموافق فيه 11/رمضان/1441ه. بشأن إختبارات تقييم الخبراء المعتمدين لدى لجنة إعادة التنظيم المالي  رئيس لجنة إعادة التنظيم المالي - بعد الاطلاع على القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات والصلاحيات الوزراء وتعديلاته،  - وعلى المرسوم بقانون اتحادي رقم (5) لسنة 2011 في شأن تنظيم مجالس الإدارات والأمناء واللجان في الحكومة الاتحادية، - وعلى المرسوم بقانون اتحادي رقم (9) لسنة 2016 بشأن الافلاس وتعديلاته، - وعلى قرار مجلس الوزراء رقم (4) لسنة 2018 بشأن تشكيل لجنة إعادة التنظيم المالي، - وعلى دليل شروط ومعايير القيد في قائمة الخبراء في شؤون إعادة التنظيم المالي والصلح الواقي والتصفية والإفلاس والإعسار بدولة الإمارات العربية المتحدة، المعتمدة من لجنة اعادة التنظيم المالي بتاريخ 4 مايو 2020م، - وبناء على قرار لجنة إعادة التنظيم المالي رقم (2/5) لسنة 2020 بتاريخ 4 مايو 2020 بشأن إجراء إختبارات تقييم الخبراء المعتمدين لدى لجنة إعادة التنظيم المالي وتحميل الخبراء تكاليف تلك الاختبارات. تقرر ما يلي:,
المادة الأولى- الاختبارات والمقابلات ورسومها*, تعتمد انواع الاختبارات والمقابلات ورسومها التي سيتم تطبيقها على الخبراء المختصين في شؤون إعادة التنظيم المالي والصلح الواقي والتصفية والإفلاس والإعسار بدولة الإمارات العربية المتحدة، وذلك كما يلي: - تقييم (اللغة الإنجليزية)			120 درهم - تقييم المقياس النفسي 			450 درهم - الاختبار التخصصي 			100 درهم - المقابلات الفنية 				1300 درهم  - كتابة التقارير الشاملة للخبير		600 درهم - إصدار بطاقات العضوية للخبراء		80 درهم  - اصدار بطاقة عضوية بدل فاقد/تالف	مجانا لاول مرة,
المادة 2- تكاليف الاختبارات والمقابلات*, يتحمل الخبير تكاليف الاختبارات والمقابلات المشار إليها في المادة (1) من هذا القرار.,
المادة 3- مدة عضوية الخبير*, تكون مدة عضوية الخبير سنتين تبدأ من تاريخ إجتيازه للاختبارات والمقابلات بنجاح، وصدور بطاقة العضوية من قبل لجنة إعادة التنظيم المالي.,
المادة 4- التكليف بالقيام بمشروع تقييم الخبراء واجراء الاختبارات والمقابلات*, يكلف مركز التفوق للابحاث التطبيقية والتدريب التابع لكليات التقنية بالقيام بمشروع تقييم الخبراء وإجراء الاختبارات والمقابلات المشار إليها في المادة (1) من هذا القرار، ويتم تحصيل الرسوم الواردة في هذا القرار وفقا للعقد المبرم بين وزارة المالية والمركز.,
المادة 5- النشر والنفاذ*," ينشر هذا القرار بالجريدة الرسمية، ويعمل به اعتبارا من تاريخ صدوره. صدر عنا بتاريخ: 4 مايو 2020م.الموافق: 11 رمضان 1441ه. صدر عنا بتاريخ: 4 مايو 2020م.الموافق: 11 رمضان 1441ه. يونس حاجي الخوري يونس حاجي الخوري وكيل وزارة المالية رئيس لجنة إعادة التنظيم المالي نشر هذا القرار في عدد الجريدة الرسمية رقم 697. ص 99.  Financial Reorganization Committee's Decision No. (5/2) of 2020 on the Assessment of Experts Endorsed by the Financial Reorganization Committee Chairman of the Financial Reorganization Committee - Having perused the Federal Law No. (1) of 1972 on the Competencies of the Ministries and Powers of the Ministers, and the amendments thereof - Federal Decree Law No (5) of 2011 Regarding the Regulation of the Boards of Directors, Boards of Trustees, and Committees at the Federal Government; - Federal Decree-Law No. (9) of 2016 on Bankruptcy, and the amendments thereof; - Cabinet Resolution No. (4) of 2008 on the Formation of Financial Reorganization Committee; - The guidebook for the conditions and criteria for registration in the roaster of experts in financial reorganization, protective composition, liquidation, bankruptcy, and insolvency in the United Arab Emirates, which was approved by the Financial Reorganization Committee on 4 May 2020 AD; and, - Based on the Financial Reorganization Committee's Decision No. (5/2) of 2020, dated 4 May 2020, on the Assessment of Experts Endorsed by the Financial Reorganization Committee, and Charging the Experts for the Fees of This Assessment; Resolved the Following: Article 1 The types of assessment, interviews, and their fees to be applied to experts in financial reorganization, Protective composition, liquidation, bankruptcy, and insolvency in the United Arab Emirates, will be as follows: - English Proficiency Test 				AED 120  - Psychometric Evaluation				 AED 450 - Specialized Test 					AED 100 - Technical Interviews			 		AED 1300 - Development of Experts’ Comprehensive Reports	AED 600 - Issuance of Membership Cards for Experts		AED 80 - Replacement of lost/damaged Membership Card for free for the first time",
Article 2, The expert shall be charged the fees of tests and interviews referred to in Article (1) hereof.,
Article 3, The term of membership shall be two years as of the date of success in tests and interviews and the issuance of membership card by the Financial Reorganization Committee.,
Article 4, The Centre of Excellence for Applied Research and Training (CERT) of the Higher Colleges of Technology shall be assigned to implement the expert assessment project and carry out the tests and interviews referred to in Article (1) hereof. The fees set in this Decision shall be collected in accordance with the contract between the Ministry of Finance and the Centre.,
Article 5," This Decision shall be published in the Official Gazette, and shall come into effect as of the date of the issuance thereof.
